Grant of License
TLJ Tech Systems and Development, LLC (“Developer”) grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Email Campaigns for Bitrix24 application (“Application”) solely for your internal business purposes within the Bitrix24 platform. This license does not include the right to sublicense, assign, or transfer the Application to any third party.
Description of the Application
The Application integrates with your Bitrix24 CRM to create and send email campaigns from your contacts and via automation rules. Sending is performed by the provider you configure — your own Amazon SES account or an SMTP server of your choice — using the credentials you supply. The Application provides a message editor, segmentation, scheduling, send-pacing control, delivery/open/click tracking, a suppression list, and a robot for CRM automations.
Free Trial and Subscription
The Application offers a free allowance of 200 (two hundred) test sends per Bitrix24 portal. After reaching this limit, continued use requires a paid monthly subscription of US$100.00 (one hundred US dollars) per portal, processed by Stripe, which allows up to 50,000 (fifty thousand) sends per day. The subscription may be cancelled at any time, remaining active until the end of the period already paid. Every email sent — in campaigns, tests, or automations — counts toward the free limit. The Developer may adjust the price upon reasonable prior notice, applicable only to future billing periods.
User Responsibilities and Acceptable Use
You are solely responsible for recipient lists, the content sent, and the legal basis for contacting them, including opt-in consent where required. You agree not to use the Application to send spam, unsolicited bulk messages, or unlawful, deceptive, or rights-infringing content. You are responsible for complying with your sending provider's usage policies (Amazon SES or SMTP), applicable anti-spam laws, and Bitrix24's Terms of Service. Misuse may result in suspension of your sending account by the relevant provider, which is beyond the Developer's control.
Use Restrictions
You may not:
- Copy, modify, distribute, sell, sublicense, or rent any part of the Application;
- Reverse-engineer, decompile, or attempt to extract the source code of the Application, except as expressly permitted by law;
- Use the Application for any unlawful purpose, to send spam, or in violation of Bitrix24's or your sending provider's Terms of Service;
- Circumvent the Application's sending limits, free allowance, or billing controls.
Data and Privacy
The Application processes and stores recipient email addresses, campaign content, tracking events, and the sending credentials you provide, as detailed in the Application's Privacy Policy. You act as controller of this data and the Developer as processor, handling it only to perform the service per your instructions.
Disclaimer of Warranties
The Application is provided “as is” and “as available,” without warranties of any kind. The Developer does not guarantee email delivery, which depends on your sending provider, your domain reputation, and destination servers, nor the continuous availability of the third-party services used (Amazon SES, SMTP servers, Stripe, and Cloudflare).
Limitation of Liability
To the maximum extent permitted by applicable law, TLJ Tech Systems and Development, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, lost profits, sending-account suspension, or business interruption, arising from the use or inability to use the Application.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the City of São Paulo, State of São Paulo, Brazil.
